NEW ORLEANS — A business entity has filed a class-action lawsuit against Copart Inc., d/b/a Cash for Cars, a used car wholesaler, citing alleged violation of telephone harassment statutes.

1469 LLC filed a complaint on behalf of all other persons similarly situated on Sept. 12 in the U.S. District Court for the Eastern District of Louisiana, alleging that the used car wholesaler violated the Junk Fax Prevention Act.

According to the complaint, the plaintiff alleges that as a result of the defendant's faxes, plaintiff suffered disruption, annoyance and costs. The plaintiff holds Copart Inc., d/b/a Cash for Cars, responsible because the defendant allegedly sent unwanted and unsolicited text junk faxes and failed to include a compliant opt-out notice.

The plaintiff requests a trial by jury and seeks an order certifying the suit as a class action and appointing plaintiff and its counsel as class representatives, an award for all damages, injunctive relief, attorneys' fees, costs of litigation, pre-judgment interest and such other relief as the court deems proper.
