Man alleges he was injured in fall in Winn-Dixie in New Orleans

NEW ORLEANS – An individual is seeking damages following an alleged slip and fall in a Winn-Dixie.

Bergman Mendoza filed a suit against Winn-Dixie Montgomery LLC, doing business as Winn-Dixie #1430, in the Orleans Parish Civil District Court.

According to the claim, the plaintiff was caused personal injury on March 6, 2015, when she was at the Winn-Dixie located at 5400 Tchoupitoulas St. The suit states that the plaintiff was caused to slip and fall on a substance that had been left on the floor in the store.

The defendant is accused of negligence through maintaining the floor in a safe condition, failing to provide warning of the condition and overall negligence.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Renee L. Swanson in Gretna.

The case has been assigned to Division J Judge Paula A. Brown.
