Man seeks rescission of sale of allegedly defective Grand Design RV

BATON ROUGE – A man alleges a recreational vehicle he purchased from a Carencro dealer is defective.

Kenneth Benoit filed a complaint on Sept. 26 in the U.S. District Court for the Middle District of Louisiana against Grand Design RV LLC, Primeaux RV LLC and Bank of the West alleging that they violated the Magnuson Moss Warranty Act and Louisiana Redhibition Laws and other counts.

According to the complaint, the plaintiff alleges that on May 23, 2015, he purchased a new 2014 Grand Design Solitude RV 369RL for personal use from Primeaux RV. When delivered, the Solitude recreational vehicle was allegedly defective in materials and workmanship and such defects substantially impaired its use, safety and value. The plaintiff holds Grand Design RV LLC, Primeaux RV LLC and Bank of the West responsible because the defendants allegedly failed to perform repair work in a good and workmanlike manner within reasonable time so as to bring it into conformities with its warranties.

The plaintiff requests a trial by jury and seeks the remedy of rescission of the sales contract, revocation of acceptance and the return of the purchase price, award for out-of-pocket expenses related to any cost of repair, economic losses, litigation costs and expenses and all other relief the court deems appropriate.
