Moran Food LLC employee alleges she has been denied positions because of her age

NEW ORLEANS – An Orleans Parish woman alleges she has been denied promotions at a grocer because of her age.

Debra Mickens filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Louisiana against Moran Food LLC, doing business as Save-A-Lot LTD, alleging that the employer violated the Age Discrimination in Employment Act.

According to the complaint, the plaintiff alleges that since her employment began in July 2009, she was wrongfully passed up for a promotion to assistant manager five times due to her age, 58. As a result, she alleges she has experienced, and continues to experience, frustration, embarrassment, emotional distress and anxiety. The plaintiff holds Moran Food LLC responsible because despite being qualified for the promotional assistant manager position, defendant allegedly hired substantially younger and less-experienced employees.

The plaintiff requests a trial by jury and seeks judgment of injunctive relief, enjoining defendant from further acts of discrimination, award for compensatory and punitive damages, costs expended for this action, attorney's fees and for all other equitable and just relief.
