NEW ORLEANS – A man alleges he was injured when he was struck by a front loader while unloading cargo from a ship.
Derrick Lyons filed a complaint on Oct. 19 in the U.S. District Court for the Eastern District of Louisiana against Associated Terminals of St. Bernard LLC alleging negligence.
According to the complaint, the plaintiff alleges that on May 5, he was working in the course of his employment with Complete Logistics Services in a vessel that was moored at the dock operated by defendant ATSB when he was struck by a front loader operated by defendant's employee. As a result, he alleges he sustained injuries and damages for medical expenses, lost wages and physical and mental pain.
The plaintiff holds Associated Terminals of St. Bernard LLC responsible because defendant's employee allegedly negligently failed to sound the horn before initiating movement and failed to keep proper lookout.
The plaintiff requests a trial by jury and seeks $5.5 million in damages, plus interest, litigation costs and all other relief that are available under the circumstances. He is represented by Scott E. Silbert and R. Justin Garon of Silbert, Garon, Pitre & Friedman in New Orleans.
