Driver claims injuries after I-12 accident with semi

NEW ORLEANS – A motorist alleges she was injured in an accident in St. Tammany Parish when a semi driver entered into her lane without yielding.

Kelly Anderson filed a complaint on Nov. 29 in the U.S. District Court for the Eastern District of Louisiana against Logiflex Inc., Gabriel Gutierrez and American Inter-Fidelity Exchange alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 15, 2015, she was operating a 2014 Nissan 370 traveling westbound on Interstate 12 when Gutierrez, who was operating a semi-tractor owned by defendant Logiflex, negligently struck the side of her vehicle when merging into a lane. The plaintiff alleges the accident caused her to sustain injuries and suffer medical care expenses and loss of income. The plaintiff holds Logiflex Inc., Gutierrez and American Inter-Fidelity Exchange responsible because defendant Gutierrez allegedly failed to keep his vehicle within a single lane without endangering vehicles in other lanes and failed to see what should be seen.

The plaintiff requests a trial by jury and seeks judgment against defendant, jointly and in solido, for all damages and legal interest, costs of these proceedings and all other equitable relief the court shall deem appropriate. She is represented by Matthew D. Hemmer of Morris Bart LLC in New Orleans.
