Auto repair company alleges bank failed to protect account

GRETNA – A Jefferson Parish auto repair company is suing a bank, alleging failure to protect the plaintiff's account.

Charlie's Auto Repair LLC filed a suit Dec. 16 against Whitney Bank in the 24th Judicial District Court, alleging breach of fiduciary duty.

According to the claim, Whitney Bank failed to act properly in regards to the plaintiff's agreement with them. The suit states the bank allowed unauthorized drafts on Charlie's Auto Repair's business checking account without consulting the plaintiff. The lawsuit states this cost losses of more than $49,000.

Charlie's Auto Repair seeks all amounts owed, attorney fees and court costs. It is represented by attorney Don C. Gardner of Harahan.

The case has been assigned to Division B Judge Cornelius E. Regan.

The 24th Judicial District Court Case number 767459.
