GRETNA – A Harahan seasoning blend company is seeking damages, alleging it was not reimbursed for damages in a contamination accident.

Magic Seasoning Blends LLC filed a suit against Berkley Assurance Company in the 24th Judicial District Court on December 27.

According to the claim, Berkley issued a contaminated products insurance policy to the plaintiff for Dec. 18, 2015 to May 31, 2016, and the defendant renewed the policy from June 1-Nov. 30, 2016. The suit explains that the plaintiff purchases milled flour from Grain Craft and began to use the product in a number of blends that would be used in restaurants.

The suit states MSB learned there had been a peanut contamination of the milled flour purchased from Grain Craft. The plaintiff the shipped 1,142 cases of replacement product to clients and eliminated all traces of the contaminated blends from their facilities, the lawsuit states.

MSB filed a statement of loss, claiming more than $1 million in losses, but Berkley has has violated its payment contract through delaying its payout to the plaintiff, the suit says.

The defendant is accused of violating its obligation of good faith and fair dealing, violation of payment and adjustment of claims obligations and violation of Louisiana law.

Magic Seasonings Blends seeks damages that will be decided upon in trial, attorney fees and court costs. It is represented by attorney Peter J. Butler Jr.

The case has been assigned to Division F Judge Michael P. Mentz.
