NEW ORLEANS – Certified registered nurses have filed a class-action lawsuit against Ochsner Health System and Ochsner Clinic Foundation alleging violations of wage laws.
Desireè Bergeron, Lillian Fogarty, Patricia Gremillion, Natalie Illg, Michele Kraf, Kevin Millet and Elizabeth Nelson, individually and on behalf of all others similarly situated, filed a complaint on Jan. 23 in the U.S. District Court for the Eastern District of Louisiana against
Ochsner Health System and Ochsner Clinic Foundation
alleging that they violated the Fair Labor Standards Act and other counts.
According to the complaint, the plaintiffs allege that they suffered damages for not receiving defendants' promised proper wages and were stripped of the agreed-upon stipends and/or suffered reduced pay contrary to employment agreements. The plaintiffs holds Ochsner Health System and Ochsner Clinic Foundation responsible because the defendants allegedly willfully ignored the law by failing to pay its hourly employees their legally required compensation under the FLSA for overtime work.
The plaintiffs request a trial by jury and seek an order allowing this action to proceed as a collective action; award for compensatory, punitive and liquidated damages; attorney's fees; costs of this action and such other necessary and appropriate relief.
