BATON ROUGE – An employee for a used car dealer in Baton Rouge claims he was not paid at a rate of time-and-one-half of his regular wages for overtime work.
Bryan Carroll filed a complaint on Jan. 23 in the U.S. District Court for the Middle District of Louisiana against North American Automotive Group LLC and Michael Pierce alleging that they knowingly and willfully violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he routinely worked more than 40 hours per week, but he was not paid overtime premiums as required by law. The plaintiff holds North American Automotive Group LLC and Pierce responsible because the defendants allegedly paid him his straight hourly rate of $12 per hour regardless of how many hours he worked per week.
The plaintiff requests a trial by jury and seeks judgment against the defendants for unpaid wages, plus liquidated damages, attorneys' fees, interest and for all costs expended of this proceeding. He is represented by Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge.
