Widow blames health care provider for husband's death

GRETNA – A Jefferson Parish woman is suing health care providers, alleging their negligence caused her husband's death.

Xuan Tranh Tran, surviving spouse of Set Van Tran filed a suit Feb. 10 against Jefferson Parish Hospital Service District No. 2, Jefferson Parish, the state of Louisiana, doing business as East Jefferson General Hospital, and Dr. Robert J. Velez in the 24th Judicial District Court, alleging medical malpractice.

According to the claim Set Van Tran found he was intensely anemic after a visit with his primary physician. After being sent for a GI workup, the suit says, Tran was found to have a fungating mass and diagnosed with gastric cancer.

Following a procedure March 19, 2014, his wife discovered that Tran's J-tube was leaking stool, followed by another incident March 24, 2014, and then another March 25, 2014. Tran went into shock and was pronounced dead March 26, 2014, due to septic shock, aspiration pneumonia and cardiac arrest.

The defendants are accused of medical malpractice through failing to take the necessary steps to prevent the death of Set Van Tran, failing to see what the true medical issue was and overall negligence as health care providers.

Xuan Tranh Tran seeks trial by jury, damages to be proven at trial, attorney fees, court costs and equitable relief. She s represented by attorney Jeannie Morris of the Law Office of Jeannie Morris LLC in Metairie.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
