Hospital alleges Blue Cross owes nearly $73,000

NEW ORLEANS – A hospital is suing Blue Cross, alleging it owes more than $70,000.

St. Charles Surgical Hospital LLC filed a lawsuit Feb. 10 against Louisiana Health Service & Indemnity Company, doing business as Blue Cross/Blue Shield of Louisiana & Blue Cross/Blue Shield of Louisiana Inc., in Orleans Parish Civil District Court, alleging an open account and violation of state law.

According to the complaint, Blue Cross issued a payment of $72,926.94 directly to a St. Charles Surgical patient but failed to pay the plaintiff what it should have.

The defendant is accused of violating Louisiana R.S. 40:2010 and an open account.

St. Charles Surgical Hospital seeks all money owed, court costs, attorney fees and all appropriate relief. It is represented by attorneys Matthew A. Sherman, David R. Sherman, Patrick R. Follette of Chehardy, Sherman, Williams, Murray, Recile, Stakelum & Hayes LLP in Metairie.

The case has been assigned to Division B Judge Melvin Zeno.
