Driver, passengers sue for damages after collision

NEW ORLEANS – Several individuals are seeking damages after an alleged hit-and-run.

Clarence Hughes, Dwayne Phoenix and Tirrell Wiggins filed a lawsuit Feb. 17 against Larry Joseph and Liberty Mutual Insurance Co. in Orleans Parish Civil District Court, alleging wrongful action in a car accident.

According to the complaint, plaintiff Hughes was driving his 1999 Ford Econo E-250 on May 5, 2016, when the incident occurred. The defendant, who was operating his 2003 Toyota pickup truck, allegedly moved improperly into the left lane, striking the plaintiff's vehicle, before fleeing the scene of the accident, the complaint said. The plaintiff and the passengers all suffered from cervical and lumbar sprain, occipital headaches, nervousness, nausea, emotional stress, strain, pain, suffering and loss of enjoyment of life.

The defendant is accused of reckless driving, failing to see what he should have seen and taking part in a hit-and-run.

The plaintiffs seek all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorney Darleen Jacobs in New Orleans.

The case has been assigned to Division E Judge Clare Jupiter.
