Customer blames Waffle House for injuries

GRETNA – A Jefferson Parish man is suing Waffle House, alleging he consumed a plastic wrap at one of the defendant's restaurants.

Ivory Chopin Jr. filed a suit Feb. 21 against Waffle House Inc. in the 24th Judicial District Court, alleging negligence.

According to the claim, on Aug. 14, 2016, Chopin was dining at the Waffle House at 2443 Manhattan Blvd., Harvey. The suit states Chopin was given plastic wrap mixed in with his food, which he consumed. The lawsuit states Chopin had to seek medical attention after he began to vomit and feel nauseous, and that Waffle House has failed to remedy the damages done.

Waffle House is accused of negligently failing to properly monitor its level of food, failing to warn of the potential danger associated with consuming the food and failing to operate properly as a restaurant.

Chopin seeks all reasonable damages, attorney fees and court costs. He is is represented by attorney David A. Binegar of Binegar Christian LLC in New Orleans.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

The 24th Judicial District Court Case number 769264.
