NEW ORLEANS – A man alleges a Houma employer rescinded a job offer because of his disability.

Curtis Trahan filed a complaint on March 7 in the U.S. District Court for the Eastern District of Louisiana against Alliance Energy Services LLC alleging violation of Title VII of the Civil Rights Act and the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he applied for and was offered a job with the defendant in April 2016, but the job offer was later rescinded because a physical exam revealed the plaintiff's HIV-positive status. The plaintiff holds Alliance Energy Services LLC responsible because the defendant allegedly failed to make an individualized assessment to determine if he could be employed or whether a reasonable accommodation would enable him to be employed and discriminated against him because of his disability.

The plaintiff requests a trial by jury and seeks compensatory, consequential and punitive damages, pre- and post-judgment interest, attorney’s fees and costs and such other relief as the court deems appropriate. He is represented by Galen M. Hair, John E. Bicknell Jr. and Sarah M. Kalis of Scott, Vicknair, Hair & Checki LLC in New Orleans.
