NEW ORLEANS – A man alleges he was injured when returning to shore because the crew of a transportation company failed to take appropriate actions.

Mitchell Mouton filed a complaint on March 7 in the U.S. District Court for the Eastern District of Louisiana against Starfleet Marine Transportation Inc. and M/V Ms. Linda Lee alleging negligence.

According to the complaint, the plaintiff alleges that on March 23, 2014, he sustained serious, painful and debilitating injuries when he was tossed about the interior of defendants' vessel, the M/V Ms. Linda Lee, because of rough seas. He alleges he suffered medical expenses, loss of earnings and physical and mental pain.

The plaintiff holds Starfleet Marine Transportation Inc. and M/V Ms. Linda Lee responsible because the defendants allegedly failed to provide adequate and competent crew and failed to implement proper safety precautions and/or procedures during the very rough seas.

The plaintiff requests a trial by jury and seeks judgment against defendants for all damages reasonable under the premises, plus interest, costs of these proceedings and any other relief reasonable under the premises. He is represented by Eulis Simien and Jimmy Simien of Simien & Simien LLC in Baton Rouge.
