Former court reporter alleges disability benefits claim was wrongfully denied

NEW ORLEANS – A Kenner resident formerly employed as a court reporter for Jefferson Parish District Court alleges her claim for disability benefits was wrongfully denied.

Cherie J. Mollere filed a complaint on March 24 in the U.S. District Court for the Eastern District of Louisiana against Life Insurance Co. of North America alleging that the plan administrator violated Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she applied for disability benefits from the defendants and that her claim was denied in March 2016. She alleges she has been disabled according to the terms of the policy since November 2014. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's claims for benefits despite receipt of overwhelming proof of her disability and refused to promptly and fairly adjust and pay these claims.

The plaintiff requests a trial by jury and seeks all damages, plus interest and penalties, reasonable attorney fees, court costs and all other relief as the facts and law may provide. She is represented by James F. Willeford and Reagan L. Toledano of Willeford and Toledano in New Orleans.
