Man alleges Principal Life Insurance did not timely review appeal for benefit amount

NEW ORLEANS – A Lacombe man alleges his insurer has filed to timely review his appeal.

Ross B. Macmurdo filed a complaint on April 5 in the U.S. District Court for the Eastern District of Louisiana against Principal Life Insurance Co. alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on June 21, 2016, the plaintiff wrote to defendant appealing the amount of his monthly benefit amount. The suit states he explained that he had purchased buy-up coverage and that defendant had only calculated his benefit on the basic coverage amount, which is far less than the amount he expected to receive. The plaintiff alleges the defendant contacted him the same month stating it was reviewing his file.

The plaintiff holds Principal Life Insurance Co. responsible because the defendant allegedly has failed to render a decision within 45 days as required by ERISA.

The plaintiff seeks all benefits due, plus pre- and post-judgment interest, attorney fees, costs of suit and all other relief as the facts and law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
