LAFAYETTE – A Krotz Springs couple alleges that the recreational vehicle they purchased has defects that have not been repaired.
John A. LeBlanc and Sue LeBlanc filed a complaint on May 17 in the U.S. District Court for the Western District of Louisiana against Vanleigh RV Inc.; Dixie Motors LLC, doing business as Dixie RV SuperStores; and AmTrust Insurance Co. of Kansas Inc. alleging that they violated the Magnuson-Moss Warranty Act.
According to the complaint, the plaintiffs allege that on Dec. 27, 2016, they purchased a new Vanleigh RV 375 FL Vilano Fifth Wheel from Dixie RV SuperStores for $109,253.31. They allege that the vehicle has defective conditions, including issues with both hot water tanks, the main furnace does not work and other issues.
The plaintiffs hold Vanleigh RV Inc., Dixie Motors LLC and AmTrust Insurance Co. of Kansas Inc. responsible because the defendants allegedly have failed to repair the vehicle in a good and workmanlike manner so as to bring it into conformity with the warranties.
The plaintiffs request a trial by jury and seek rescission of the sales contract, award for damages and economic losses, interest, attorney's fees, costs of suit and all other relief as the court may deem appropriate. They are represented by Fred A. Pharis of Pharis Law Offices in Alexandria.
