BATON ROUGE – An Iowa corporation alleges a Texas general contractor failed to correct defects in a Gonzales property.
Instrument & Valve Services Co. filed a complaint on April 7 in the U.S. District Court for the Middle District of Louisiana against The Burt Group Inc. alleging breach of contract.
According to the complaint, the plaintiff alleges that on Oct. 1, 2013, plaintiff contracted defendant to provide services in connection with the construction of the Emerson Service Center. Almost immediately upon its occupancy, plaintiff claims that it began to notice damages to interior finishes of the center and these problems continue to the present. The suit states these issues include water stains and water leaks.
The plaintiff holds The Burt Group Inc. responsible because the defendant allegedly failed to correct the defects in the construction of the Emerson Service Center.
The plaintiff requests a trial by jury and seeks award for damages, plus costs, attorneys’ fees, expenses and interest and for all further relief that the court may deem just and proper. It is represented by John J. Hainkel III and Everett R. Fineran of Frilot LLC in New Orleans.
