South Carolina man sues RV manufacturer, citing defects in $120,000 unit

A South Carolina man has sued a recreational vehicle maker and two other businesses in federal court for allegedly selling him a defective product.

Francisco J. Mora filed his complaint November 1 in federal court against Thor Motor Coach Inc., Camping World RV Sales and Bank of America.

"Plaintiff has returned his Hurricane to the defendants and its authorized warranty service dealers for repairs on numerous occasions," the complaint states. "Despite this prolonged period during which defendants were given the opportunity to repair the Hurricane, the more significant and dangerous conditions were not repaired."

Mora paid $120,770 for the RV, according to the suit, which cites the federal Magnuson-Moss Warranty Act.

"Plaintiff’s purchase of the Hurricane was accompanied by express warranties offered by the defendants, THOR , and extending to Plaintiff," the suit states. "These warranties were part of the basis of the bargain of plaintiff’s contract for purchase of the Hurricane."

Alleged defects include leaking hydraulic fluid, broken sliding doors and kitchen cabinets separating below the sink, according to the suit.

"The defects experienced by plaintiff with the Hurricane substantially impaired its use, value and safety," the lawsuit states.

Mora seeks a refund of the full purchase price plus finance charges, insurance premiums and repair costs. He is also asking for legal fees.
