Auto insurer sued for not covering total cost of stolen car

GRETNA – An auto insurance company is being sued by a customer who claims it wrongly denied his claim after his car was stolen.

Charles Williams filed suit against State Farm Mutual Automobile Insurance Company in the 24th Judicial District Court on May 8.

Williams contends that on May 20, 2013 his 2007 Infiniti G35 was stolen from in front of a Shell gas station located at the intersection of Banks and Broad Street in New Orleans. The plaintiff asserts that when he exited the gas station he realized the car had been stolen and notified the New Orleans Police Department that night and the next day called State Farm to report the theft. Williams claims that at the time of the theft he carried comprehensive auto insurance with the defendant including in the case of auto theft.

The plaintiff alleges State Farm failed to fairly and properly adjust and pay the claim.

The defendant is accused of breach of contract and violation of state law.

An unspecified amount in damages is sought for the fair market value of the vehicle.

Williams is represented by Kevin J. Katner of New Orleans-based The Katner Law Firm LLC.

The case has been assigned to Division F Judge Michael P. Mentz.
