Construction company sued for allegedly not completing construction on new home

BATON ROUGE – A married couple is suing a local construction company for breach of contract for allegedly not completely finishing construction on their new home before allowing them to move in.

Danny and Melissa Coleman filed suit against D.D. Construction Incorporated in the 19th Judicial District Court on April 16.

According to court records, the plaintiffs hired Hurt Construction to build a new home for them on land they already owned located at 2651 North Turnberry in Zachary. The plaintiff and the defendant entered into a written building contract titled “Builders Contract.” Under the terms of the contract, the plaintiffs claim they were to pay “cost plus fixed fee contract” for the construction. The Colemans claim they were billed a total of $1,134,458 once Hunt Construction said the home was completed.

On April 18, 2014, the Colemans assert they moved their furniture and belongings into the house, but noticed after moving in that the defendant failed to fully complete all aspects of the construction as specified by the plans. At their expense, the Colemans claim they hired an engineering firm to evaluate the construction of their home and that the evaluation uncovered numerous defective items in their home.

The defendant is accused of violating the warranties provided under the Louisiana New Home Warranty Act and failing to fully complete all aspect of the Colemans’ residence as required by the plans. Furthermore, the plaintiffs states that Hunt Construction breached the term of the builders contract.

An unspecified amount in damages is sought for actual damages, cost of inspections, engineering reports, emotional distress and court fees.

This case has been assigned to Division D Judge Janice Clark.
