Former NOPD officer sues City for red light camera infraction

Judge Rosemary Ledet will hear a motion for exception for no right of action in a red light camera suit against the city of New Orleans on Friday in Orleans Parish Civil District Court.

Glen Forman, a disabled and former NOPD officer, filed a lawsuit against the city for a ticket he received in March from a red light camera. At an administrative hearing in March, Forman asked to for the presence of a city employee or police officer that had seen him commit the traffic violation or had reviewed the photo of the incident but he was denied.

Forman's ticket was later dismissed in June but he has not withdrawn his suit.

New Orleans assistant City Attorney Detrich Hebert filed a motion for no right of action on June 30 questioning the plaintiff's standing in the case. He argued that, "because the citation was administratively dismissed, it lacks a legally protectable and tangible interest at stake in the litigation."

There is currently a class action suit questioning the legality of the city's red light cameras in Orleans Parish brought on by Metairie attorney Joseph McMahon.

Judge Kern Reese is overseeing that case.
