Man sues apartment complex and its employees over slip on fall on stairs

Orleans Parish resident Darryl Williams is suing his apartment complex owner and several of its employees after he slipped and fell in a stairwell on the property.

New Orleans attorneys Christopher Rodriguez and Michael Rodriguez Sr. filed the petition for damages Dec. 9 in Orleans Parish. The suit names Audubon Communities Management LLC, Max Specialty Insurance Co., Leslie Lockhart, Samantha Lockhart, James Thomas and Shalimar Green as defendants.

The suit claims that the defendants are liable for damages because they "had prior notice of the dangerous condition" of the stairwell and the petition pleads the doctrines of res ipsa loquitor and strict liability.

As a result of the fall, the plaintiff alleges he suffered "severe sprain and/or strain" of his lumbar spine, cervical spine as well as "dizziness, chest pains and emotional upset and distress."

The lawsuit states that the individuals involved are liable because they "failed to discharge the duties" of their respective positions as Audubon employees, among other charges.
