An Orleans Parish woman has filed a lawsuit against a construction company after she fell while attempting to go under pipe to reach her vehicle.
Eight months pregnant at the time of the accident, April Washington filed suit against A & L Underground Inc. on April 8 in Orleans Parish District Court. The defendant removed the case to federal court in New Orleans on May 17.
The incident occurred on Nov. 10, 2010 as April Washington was leaving her residence on Apple Street in New Orleans. She states there was construction on the street, with round metal pipes that were parallel to the sidewalk that ran the length of the street. Washington was attempting to get to her vehicle but could not go around the pipe or over it. She attempted to go under the pipe and fell.
The defendant is accused of negligence for blocking street access from the homes along Apple Street, failing to allow sufficient, safe access to the street and failing to warn.
The plaintiff is seeking damages for physical pain, suffering, anguish, mental fright, shock, loss of enjoyment of life, disability, lost wages, loss of earning capacity, interest and court costs.

U.S. District Judge Stanwood R. Duval Jr. is assigned to the case.
