Wal-Mart store sued by shopper who slipped in water from ice cooler

A Wal-Mart shopper has filed a lawsuit against the Ponchatoula store after she slipped in water that was leaking from the store's ice cooler.

Kisha Johnson filed suit against Wal-Mart Stores Inc. on July 11 in the Tangipohoa Parish District Court. The defendant removed the case to federal court in New Orleans on Aug. 16.

The alleged incident occurred on July 10, 2011 as Joseph was shopping in the Wal-Mart located in Ponchatoula.

The defendant is accused of failing to use reasonable care to keep aisles, passageways and floors in a clean and safe condition, failing to use reasonable care to keep the premises free of hazardous condition, failing to properly inspect the premises, failing to establish proper procedures for cleaning and inspection, in allowing a foreign and dangerous substance to remain on the floor of the store creating an unreasonable and foreseeable risk and hazard of injury, and having notice of the condition which caused Johnson's injury prior to its occurrence.

The plaintiff is seeking damages for pain, disability, medical expenses, impairment of earning capacity, loss of love and affection, interest and court costs.

Johnson is represented by Monica Grant Moton of Lewis, Brisbois, Bisgaard & Smith in New Orleans. A jury trial is requested.

U.S. District Judge Eldon E. Fallon is assigned to the case.
