Captain sues after reckless roommates fall from top bunk on top of him

A boat captain has filed a lawsuit against his employer after he was injured when two reckless co-workers fell from a top bunk.

Kevin Edwards filed suit against Environmental Safety and Health Consulting Services Inc. and Safety Management Systems on Aug. 23 in Terrebonne Parish District Court. The defendants removed the case to federal court in New Orleans on Sept. 29.

The alleged incident occurred on April 18 when Kevin Edwards, who was sharing a room with two roommates, was injured while he was sleeping on the bottom bunk of his living quarters. Edwards states he was injured by his roommates, who were acting reckless and negligent by falling on his right leg.

The defendants are accused of negligence for being inattentive, failing to maintain a proper lookout, acting in a reckless and careless manner, failing to see what they should have seen or what they should have done.

The plaintiff is seeking more than $50,000 in damages for medical expenses, lost earnings, loss of earning capacity, physical pain and suffering, mental and emotional anguish, disability, loss of enjoyment of life, interest and court costs.

Edwards is represented by Lafayette attorneys Joseph F. Gaar Jr., Jason M. Welborn, Willard P. Schieffler and Lucas S. Colligan.

U.S. District Judge Jay C. Zainey is assigned to the case.
