An oil spill claims adjuster has filed age discrimination lawsuit against his employer after he was included in a group of older employees who were terminated.
Michael E. Sullivan filed suit against Worley Catastrophe Services on Oct. 14 in federal court in New Orleans.
Sullivan was employed by Worley Catastrophe Services from July 19, 2010 until Sept. 18, 2010 as an adjuster for BP oil spill claims. Sullivan states he was wrongfully discharged due to his age.
According to the lawsuit, he was in a group of "generally older and more experienced workers" who lost their jobs in September. The workers who were retained were younger and less experienced than Sullivan, the suit claims.
The defendant is accused of violating the Age Discrimination in Employment Act by terminating Sullivan because of his age, refusing to consider Sullivan for remaining positions because of his age and breaching Sullivan's employment agreement by refusing to pay him the full amount due.
The plaintiff is seeking an award of special, general compensatory and punitive damages, plus court costs and attorney's fees.
Sullivan is represented by New Orleans attorney David A. Dalia. A jury trial is requested.
U.S. District Judge Lance M. Africk is assigned to the case.
