Texaco is facing a federal lawsuit filed by Tangipahoa resident who claims he is suffering from multiple myeloma caused by exposure to benezene at a Louisiana company more than 35 years ago.
Danny L. Goodwin, Machelle Goodwin, Ian Goodwin and Haiden Goodwin filed suit against Texaco Inc., Employers Insurance Co. of Wausau and ABC Insurance Co. on Oct. 27 in federal court in New Orleans.
Danny Goodwin worked at Ormet Corp. in Burnside, La. from 1973 to 1976. During his employment, Goodwin worked in the pump room as a millwright breaking down pumps and cleaning in a vat filled with benzene. He claims his exposure resulted in damage to his bone marrow and blood forming organs, resulting in multiple myeloma.
Defendant Texaco supplied benzene, grease, and oils in 55-gallon drums to Ormet Corp. The defendants are accused of negligent misrepresentation, concealing, suppressing, omitting material information about the health effects of benzene and failing to inform users of precautionary measures to be used when handling or near benzene.
Goodwin and his family are seeking damages for physical pain and suffering, mental anguish and emotional distress, disfigurement and embarrassment, physical impairment, lost earnings, loss of earning capacity, physical impairment, physical and mental disability, medical expenses, loss of enjoyment of life, fear of cancer and other diseases, loss of society, consortium, companionship, services, nurture and love and affection, wrongful death damages, survival damages, court costs and interest.
The plaintiffs are represented by L. Eric Williams, Jr. of Williams Law Office in Metairie and Richard J. Fernandez and Amber E. Cisney of Richard J. Fernandez, LLC of Metairie.
U.S. District Judge Martin L. C. Feldman is assigned to the case.
