Orleans Parish worker sues after allegedly being pushed down stairs by project manager

An Orleans Parish resident has filed a lawsuit against his employer after he suffered injuries when a project manager allegedly pushed him and he fell down stairs.

Rudolph Kennedy filed suit against Christopher Lovelace, Utility Construction Group Inc., N & B Trucking, ABC Insurance and XYZ Insurance on Aug. 26, 2011 in St. Bernard Parish Civil District Court. The defendants removed the case to federal court in New Orleans on Oct. 27.

The alleged incident occurred on Aug. 27, 2010, while Kennedy was employed by N&B Trucking and hired by Utility Construction to haul dirt at a job site located in St. Bernard Parish. Kennedy states he was severely injured when he was attacked by project manager Christopher Lovelace. Lovelace allegedly pushed Kennedy out of the mobile work trailer, causing Kennedy to fall down four or five steps.

As Lovelace was employed by Utility Construction Group at the time of the incident, the defendant is responsible pursuant to the doctrine of respondeat superior, the suit claims.

The plaintiff is seeking damages for physical and mental pain and suffering, lost earnings, loss of earning capacity, interest and court costs.

Kennedy is represented by Robert P. Blackburn, Roger W. Kitchens and F. Gerald DeSalvo of DeSalvo, Blackburn & Kitchens in New Orleans. A jury trial is requested.

U.S. District Judge Ivan L.R. Lemelle is assigned to the case.
