A nursing home worker who had been accused of being cruel to residents has filed a lawsuit against his employer after criminal charges against him were dismissed.
Nathaniel Monroe filed suit against Nexion Health at Thibodaux Inc. d/b/a Thibodaux Health Care on Dec. 7 in federal court in New Orleans.
His employer reported that Monroe had abused a nursing home resident on Dec. 31, 2009, and subsequently Monroe was charged with cruelty to the infirm. He was arrested a second time on Jan. 21, 2010 and again charged with cruelty to the infirm.
Monroe states that the charges were dismissed by the district attorney's office on Aug. 24, 2011, because he obtained evidence from co-workers that the charges of nursing home abuse were false, the lawsuit states.
The plaintiff is seeking an award of lost pay and wages, loss of reputation, injury to character, mental distress, mental anguish, embarrassment, emotional distress and anguish, medical expenses, interest, court costs, and attorney's fees.
According to the lawsuit, Monroe has been working with the elderly for more than 30 years and was awarded a 2008 employee of the year award.
Monroe is represented by Ravi K. Sangisetty of Sangisetty & Samuels in New Orleans. A jury trial is requested.
U.S. District Judge Helen G. Berrigan is assigned to the case.
