Shopper sues JC Penney after falling in restroom

After slipping in water and falling, a shopper has filed a lawsuit against JC Penney for failing to maintain its bathroom floors in a safe condition.

Sharon Serpas and James Serpas filed suit against the retailer as well as John Doe, and XYZ Insurance Co. on Nov. 2 in St. Tammany Parish District Court. The defendants removed the case to federal court in New Orleans on Dec 8.

The alleged incident occurred on Nov. 1, 2010, as Sharon Serpas was shopping at a store located in Northshore Mall in Slidell. W

Serpas is seeking damages for medical expenses, lost income and earning capacity, mental and physical pain and suffering, inconvenience, loss of enjoyment of life, loss of consortium, interest and court costs.

The plaintiffs are represented by Slidell attorneys Richard A. Tonry II, Raymond J. Brinson, Brian L. Glorioso and Kristine K. Sims.

U.S. District Judge Sarah S. Vance is assigned to the case.
