Seaman sues after tripping and falling due to vessel's flooring

A seaman is suing Transocean for personal injuries he received when he fell on allegedly inadequate flooring.

John Howard filed suit against Transocean Offshore USA Inc. on Dec. 6 in federal court in New Orleans.

The alleged incident occurred on March 10, as Howard was walking across boards to get from room to room on the M/V Deepwater Navigator. He states the flooring caused him to fall and injure his left ankle and foot.

The defendant is accused of negligence for breaching a legally imposed duty of reasonable care, for failing to properly maintain the area vessel flooring which caused Howard to fall, failing to properly design and outfit the vessel flooring and failing to properly warn Howard regarding the dangerous condition on the vessel.

The plaintiff is asking the court for an award of physical, mental and emotional pain and suffering, loss of wages, fringe benefits and wage earning capacity, physical disability, medical expenses, punitive damages, interest and court costs.

Howard is represented by Timothy J. Young, Jason C. Macfetters and Rebecca A. Coman of The Young Firm in New Orleans. A jury trial is requested.

U.S. District Judge Carl J. Barbier is assigned to the case.
