An oil spill cleanup worker has filed a lawsuit against his employer after he suffered respiratory failure as a result of exposure to oil products.
Luke Boudreaux filed the lawsuit against Craig Creppel and the DRC Group on Dec. 29, 2011 in federal court in New Orleans.
The alleged incident occurred on Sept. 28, 2010 as Boudreaux was employed by the defendants as a crewmember of the vessel Captain Matt.
The vessel and its crewmembers were conducting BP oil spill cleanup operations in the Gulf of Mexico. Boudreaux claims that he suffered acute hypoxic respiratory failure and bipolar pneumonia as a result of his exposure to toxic oil products being remediated by the vessel.
The defendants are accused of negligence for failing to properly equip, man, maintain and operate the vessel, for failing to select and implement an overall plan to complete the tasks at hand in a safe and non-hazardous manner, failing to provide a safe and non-hazardous workplace, and for failing to provide proper and sufficient tools and manpower to complete the tasks at hand.
The plaintiff is asking the court for an award of damages for disabling injuries, emotional trauma, distress, post-traumatic stress, loss of future life pleasures, permanent impairment, loss of wages and benefits, loss of wage earning capacity, medical expenses, maintenance and cure, attorney's fees and court costs.
Boudreaux is represented by Bobby J. Delise and Alton J. Hall, Jr. of Delise & Hall in New Orleans and New Orleans attorney Gregory P. Dileo. A jury trial is requested.
U.S. District Judge Lance M. Africk is assigned to the case.
