Man sues Verizon Wireless after falling from broken bench

NEW ORLEANS - Robert Gordon of Jefferson Parish filed suit against Verizon Wireless in Jefferson Parish District Court claiming it failed to care for the safety of patrons after he fell from a broken bench.

The defendant recently removed the case, originally filed in December, to federal court in New Orleans.

The alleged incident occurred on Dec. 31, 2010 while Gordon was at the Verizon Wireless location in Harvey. Gordon states that he had just sat down on a bench when the right front leg of the bench broke off and he fell to the floor. He claims the incident caused serious and painful injuries.

The plaintiff is seeking damages for physical pain and suffering, mental anguish, medical expenses, disability, lost income and wages, diminution of earning capacity, impairment of life's pleasures, humiliation, embarrassment, interest and court costs.

Gordon is represented by Darryl M. Phillips and Angela Lumzy Jones in The Cochran Firm in New Orleans.

U.S. District Judge Carl J. Barbier is assigned to the case.
