NEW ORLEANS - A Chinese national has filed a Jones Act lawsuit against several Louisiana shipping companies after he was injured when a mooring line broke loose and struck him.
Changxing Yu filed suit against Dalian International Maritime Services Co. Ltd., Fujian Guanhai Shipping Co. Ltd., Tianjin Cosbulk Ship Management Co. Ltd. and Shoushan Shipping Ltd. on Nov. 14, 2011 in Plaquemines Parish District court. The defendants removed the case to federal court in New Orleans on March 14.
While working aboard the M/V Shou Shan on the Mississippi River on April 1, 2011, a large mooring line broke loose striking Yu in the wrist area.
The defendants are accused of negligence for failing to provide Yu with a safe place to work, failing to provide Yu with appropriate safety equipment, failing to properly supervise Yu's activities and maintain appropriate safety standards, failing to properly man the vessel and provide proper training to Yu, and for failing to properly supervise Yu's activities.
Yu is asking the Court for an award of damages for pain and suffering, mental anguish, disfigurement, medical expenses, loss of income, loss of society, consortium and enjoyment of life, loss of found, maintenance and cure, punitive damages, interest and attorney's fees.
The plaintiff is represented by Richard J. Dodson and Michael T. Beckers of Dodson, Hooks & Frederick in Baton Rouge, New Orleans attorney Donglai Yang and Phillip F. Cossich Jr. of Cossich, Sumich, Parsoila & Taylor in Belle Chasse. A jury trial is requested.
U.S. District Judge Helen G. Berrigan is assigned to the case.
