NEW ORLEANS - A Jefferson Parish woman claims she was knocked unconscious after being struck by grocery carts being moved by a motorized device at a Sam's Club in Metairie.
Ellen Alqrainy and Saad Alqrainy filed suit against Wal-Mart Stores Inc. d/b/a Sam's Club on March 16 in federal court in New Orleans.
The alleged incident occurred on Dec. 26, 2011 as Ellen Alqrainy was assisting a little girl who was attempting to separate grocery carts. Immediately thereafter, Alqrainy states that she was struck by a line of grocery carts being pushed by a motorized device and steered by a Sam's Club employee. She was knocked to the floor and hit her head causing her to lose consciousness.
According to the lawsuit, the Sam's Club employee admitted that he caused the accident and that it was his first day retrieving the grocery carts.
The defendant is accused of negligence for failing to use reasonable care in manipulating or pushing the grocery carts, failing to properly protect patrons from injury, failing to train its employees on pushing, moving and placing of grocery carts, failing to properly keep a look-out while moving the grocery carts, and failing to establish proper procedures regarding moving the grocery carts.
Alqrainy is asking for an award of damages for pain, disability, medical expenses, loss of enjoyment of life, loss of consortium, emotional damages, cost of hiring housekeepers to maintain residence, orthopedic equipment and for bedroom furniture to accommodate injuries, interest and court costs.
The plaintiffs are represented by J. Douglas Sunseri of Nicaud & Sunseri in Metairie.
U.S. District Judge Martin L. C. Feldman is assigned to the case.
