NEW ORLEANS - Claiming he suffered injuries when parts of an elevator fell onto him, a seaman is suing his employer for negligently failing to maintain the elevator.
Phillip Larwood filed suit against Diamond Offshore Drilling Inc. and Diamond Offshore Management Co. on March 16 in federal court in New Orleans.
The alleged incident occurred on March 26, 2009 as Larwood was working on his drill floor and elevator inserts came free from the elevators and fell onto Larwood, his suit claims.
The defendant is accused of negligence in failing to provide a safe workplace, for having defective elevators or elevators that were in poor repair, failing to maintain the elevators and for failing to conduct meaningful inspections which would have revealed the defective elevators.
The plaintiff is asking for an award of damages for medical expenses, pain and suffering, mental anguish, disability, humiliation and embarrassment, wage loss, lost earning capacity, maintenance and cure, and interest.

U.S. District Judge Stanwood R. Duval Jr. is assigned to the case.
