Toys R Us sued after customer slips in bubble puddle

NEW ORLEANS - A Jefferson Parish woman has filed a lawsuit against a toy store after she slipped in a puddle of bubble solution and fell.

Carolyn Cabrera filed suit against Toys "R" US-Delaware Inc. on April 18 in Jefferson Parish District Court. The defendant removed the case to federal court in New Orleans on May 22.

The alleged incident occurred on Feb. 22 as Cabrera was shopping at the Toys "R" Us store located on Lapalco Boulevard in Marrero.

The defendant is accused of negligence for failing to give warnings of the dangerous condition, failing to properly inspect and maintain the area in question to discover the dangerous condition, failing to warn of inherent dangers associated with things under its custody and control, failing to remove the puddle of "bubble" solution, failing to properly supervise and instruct its employees, and for allowing a hazardous condition to exist, which presented an unreasonable risk of harm to its customers.

The plaintiff is asking for an award of damages for medical expenses, physical pain and suffering, mental pain and anguish, physical disability, physical disfigurement and scarring, loss of enjoyment of life, lost wages, lost earning capacity, interest, and court costs.

Cabrera is represented by George Recile of Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum & Hayes in Metairie. A jury trial is requested.

U.S. District Judge Helen G. Berrigan is assigned to the case.
