Seaman seeks more than $5 million claiming ladder falls on top of him

NEW ORLEANS - A seaman has filed a lawsuit seeking more than $5 million claiming that he suffered disabling spinal injuries when a ladder fell on top of him.

James Thomas filed suit against Rockin D Marine Services on May 22 in federal court in New Orleans.

The alleged incident occurred on April 4, 2012 as Thomas was picking up a hose on the back deck of the M/V Sea Cecile. He states that the overboard ladder on a higher deck/level came unsecured and broke free from being secured and fell on top of him.

He suffered disabling and permanent injuries to his spine, the suit claims.

The plaintiff is asking for damages for mental and physical pain and suffering, lost wages, medical expenses, loss of enjoyment of life, maintenance and cure, punitive damages, court costs and attorneys' fees.

Thomas is represented by Thomas M. Discon of Discon Law Firm in Mandeville and Robert K. Lansden of Ponchatoula.

U.S. District Judge Jay C. Zainey is assigned to the case.
