Recile

NEW ORLEANS - A Dollar General shopper is suing the store after she slipped and fell in a puddle of liquid dish detergent.

Mary Wilcox filed suit against Dolgencorp. d/b/a Dollar General on April 13 in Tangipahoa Parish District Court. The defendant removed the case to federal court in New Orleans on June 1.

The alleged incident occurred on Feb. 12 as Wilcox was shopping at the Dollar General store located in Ponchatoula.

According to the lawsuit, the detergent was spilled and allowed to accumulate in one of the aisles on the floor.

The store is accused of negligence for failing to give warnings of the dangerous condition, failing to properly inspect and maintain the area in question to discover the dangerous condition, failing to warn of the inherent dangers associated with things under its custody and control, failing to remove the puddle of spilled liquid dishwashing detergent, and for allowing a hazardous condition to exist, which presented an unreasonable risk of harm to its customers.

The plaintiff is asking the court for an award of damages for medical expenses, physical pain and suffering, mental pain and anguish, physical disability, physical disfigurement and scarring, interest, and court costs.

Wilcox is represented by George B. Recile of Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum & Hayes in Metairie and Metairie attorney Troy Keller.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
