Home Depot sued after shopper hit in head by metal pipe

NEW ORLEANS - A Home Depot shopper is suing the store claiming he was struck in the head by a heavy metal pipe, which fell from a lumber bin.

Randy J. Lassere filed suit against The Home Depot U.S.A. Inc. d/b/a Home Depot Store #03730 on July 18 in St. Bernard Parish District Court. The defendant removed the case to federal court in New Orleans on Aug. 20.

The defendant is accused of negligence for failing to adequately warn Lassere of the dangerous condition of the lumber bin, failing to close off the section containing the lumber bin until the known defect was corrected, failing to require and perform regular and adequate schedule of inspections of the premises, failing to correct a hazardous condition, and for failing to properly train or supervise its employees.

The plaintiff is seeking damages for medical expenses, physical pain and suffering, mental anguish, emotional distress, loss of enjoyment of life, physical impairment and disability, and interest.

Lassere is represented by Slidell attorney Randolph C. Slone.

U.S. District Judge Eldon E. Fallon is assigned to the case.
