Daycare sued by parents alleging child was injured while under their supervision

NEW ORLEANS – A New Orleans daycare is being sued by parents alleging their child was left unsupervised, which resulted in the child being injured.

Vincent Evans and Brittany Smith, on behalf of their son Vincent Evans Jr., filed suit against Magical Moments Learning Center, Ayana Blanchard, John Doe and ABC Insurance Co. in the Orleans Parish Central District court on Aug. 2.

The petitioners claim that while their son was under the care and supervision of the defendants he was picked up by another child in the daycare and dropped on his face and head. Evans and Smith allege as a result of the drop their son suffered injuries to his face, mouth and head.

The defendant is accused of failure to properly supervise the children, failure to ensure child safety and breach of fiduciary duty due petitioners.

An unspecified amount in damages is sought for all damages including medical expenses, pain and suffering and permanent disability. The court is to determine the amount.

The plaintiff is represented by K. Adam Avin of New Orleans-based law firm Irpino Law Firm.

The case has been assigned to Division I Judge Piper D. Griffin.
