BATON ROUGE – A married couple has filed suit against a restaurant franchise for injuries they claims they received on the premises.
Terry and Sharon Simoneaux filed suit against General Mills Restaurant, Inc., D/B/A Red Lobster and Liberty Mutual Fire Insurance Company in the 19th Judicial Court on July 31.
Terry was leaving Red Lobster on Bluebonnet Boulevard when he allegedly fell in the parking lot, due to a sudden drop off the sidewalk.
Sharon is suing for alleged personal damages from the injuries of her spouse.
The defendant is accused of failure to maintain their premises in a safe condition, failure to warn customers of a known hazard, failure to implement a system to prevent these types of dangers, failure to take reasonable measures to remedy the situation and failure to inspect and remove such hazards.
Terry seeks an unspecified amount in damages for physical pain and suffering, medical treatment and expenses, mental anguish pain and suffering, loss of enjoyment of life, potential economic loss, lost wages and permanent disability.
Sharon's alleged damages include a loss of consortium, loss of society, services, support, companionship, anguish and destruction to all usual enjoyments of her marital relationship with spouse.
The plaintiffs are represented by Robert M. Lucky of The Lucky Law Firm, PLC.
The case has been assigned to Division A Judge Todd Hernandez.
