NEW ORLEANS - A utility man has filed a lawsuit claiming he suffered disabling injuries when parts of a crane broke free and fell, landing on top of him.
Trevis Nelson filed suit against Cooper T. Smith Stevedoring Co. Inc. on Dec. 5 in federal court in New Orleans.
While working as an utility man for the defendant, Nelson was allegedly injured on Sept. 16, 2012 when a spreader bar came free or broke free from the crane and fell. The bar landed on Nelson and caused injuries to his head and neck, the suit claims.
The defendant is accused of negligence for failing to furnish Nelson with a safe place to work and for failing to properly secure the spreader bar.
The plaintiff is asking for an award of damages for maintenance and cure, mental and physical pain and suffering, lost wages, medical expenses, loss of enjoyment of life, punitive damages, attorney’s fees, interest, and court costs.
Nelson is represented by Thomas M. Discon of Discon Law Firm in Mandeville.
U.S. District Judge Sarah S. Vance is assigned to the case.
