Woman stuck in train ride due to her size sues City of New Orleans and City Park

NEW ORLEANS – An Orleans Parish woman claims there was not adequate space to exit a City Park train which resulted in her body allegedly becoming lodged in the exit.

Shirley Smith filed a lawsuit against New Orleans City Park Improvement Association and City of New Orleans in the Orleans Parish Central District Court on Nov. 5. Smith claims that her body became lodged in the narrow exit of the train due to her size. As a consequence of her being stuck, she suffered injuries to her body, the suit claims.

The defendant is accused of failing to provide emergency assistance to the plaintiff so as to prevent injury and failure to provide adequate equipment for entering and exiting the train.

An unspecified amount is sought for pain and suffering, medical expenses, loss of enjoyment of life and emotional distress.

Smith is represented by Hollis Shepherd.

This case has been assigned to Division N Judge Ethel S. Julien.
