NEW ORLEANS – A local theater and theater company are being sued over injuries sustained by an audience member after an actor leaped from stage during a performance of “Rock of Ages.”
Colleen M. Kottemann Sutherland and Glenn Sutherland filed a lawsuit against Arts Center Enterprises – New Orleans, LLC, commonly known as Mahalia Jackson Theater, Phoenix Entertainment, LLC, Bourbon Room Rocks, LLC, Key Brand Entertainment, Inc. d/b/a Broadway Across America, Stephen Kane, Michael McFadden, Kristin Hanggi and Kelly Devine in the Orleans Parish Central District Court.
Glenn Sutherland claims that during a performance one of the actors jumped on his leg and knee causing severe and debilitating injuries. Sutherland also claims he had to have surgery following this incident and is permanently disabled.
The defendants are accused of failing to properly supervise activities on its premises, failing to warn patrons of any dangerous activities that may occur during production, negligently injuring the plaintiff, negligent battery upon plaintiff, failing to properly supervise actors and failing to prohibit dangerous activities.
An unspecified amount is sought for the alleged extensive personal injuries of the plaintiff’s knee, mental anguish, economic loss, medical expenses and loss of consortium on Sutherland’s behalf.
The plaintiffs are represented by Val Patrick Exnicios of Liska, Exnicios & Nungesser.
