NEW ORELANS - Gibbs Construction LLC filed a lawsuit against Safway Services, LLC in the Orleans Parish Central District Court alleging breach of contract.
The complaint states that the defendant’s delivery of a scaffolding system used in the renovations of the Superdome 54 days past the time constraints agreed upon in the contract resulted in $140,000 worth of liquidated damages. Gibbs also claims that the defendants owe a total of $69,707.50 for additional cost incurred for crane rental used to install the scaffolding system.
The defendant is accused of failure to submit payment after amicable demand, breach of contract and causing the plaintiff to incur liquidated damages.
The plaintiff is seeking to recover damages, interest, attorney’s fees and all court costs.
