Touch of Class Concrete sued over construction site injury

NEW ORLEANS - An employee of Dillon Bros. Ready Mix Concrete is suing Touch of Class Concrete Pumping claiming negligence by one of its employees resulted in bodily injury.

Jamie R. Davis filed suit in the Orleans Parish Central District Court on Nov. 26. Davis claims that the defendant failed to properly connect a pipe to a concrete hopper which resulted in the pipe blowing off in the course of completing work at a construction site. The concrete hopper flew off causing Davis to allegedly sustain injury in the chest, neck and shoulder region.

The defendant is accused of failing to properly complete the task of attaching the pipe to the concrete hopper, failing to properly train employees and failing to confirm if the pipe was adequately secured to the hopper.

An unspecified amount is sought for lost wages, medical expenses, pain and suffering and permanent disability.

The plaintiff is represented by Lloyd N. Frischhertz of Frischhertz, Poulliard, Frischhertz& Impasto, LLC.

This case has been assigned to Division A Judge Tiffany G. Chase.

Case no. 2012-10903.
